ClearCyprus: Cyprus Inheritance Tax: There Isn't One, but Three Other Things Can Still Cost Your Family

You are sitting at the kitchen table in Paphos, a UK mortgage statement on one side and a Cyprus title deed on the other. A friend says, "At least Cyprus has no inheritance tax." That is true, but it is not the whole story.

Cyprus charges no inheritance tax or estate duty on assets passing at death, so your heirs pay no Cyprus tax simply for receiving them. The costs and risks sit elsewhere: in your home country's tax rules, in Cyprus succession law, and in the administration needed to move assets into your heirs' names.

What "no inheritance tax" does and does not cover

Cyprus abolished estate duty years ago. An heir who receives a house, a bank balance or shares from a Cyprus estate pays no Cyprus tax on the receipt itself. Most online sources quoting a Cyprus inheritance tax rate are either out of date or describing another country.

Three things sit outside that headline:

  • Fees and charges on transfer. Registering a property in the heir's name at the Land Registry involves official charges and certified paperwork. Check the current position with the Department of Lands and Surveys rather than trusting a figure from a blog.
  • Tax on later sales. The inheritance is not taxed, but a later sale can be. Before anyone lists the property, ask a licensed Cyprus adviser how the heir's starting value is treated.
  • Tax in another country. This is the catch most people miss. The next section covers it.

The tax that can follow you from the UK

Moving to Cyprus does not automatically switch off UK inheritance tax. The UK changed its test from 6 April 2025, and it now looks at how long you have been resident in the UK, not only at your domicile. Someone who lived in the UK for many years can stay inside the UK net for a period after leaving.

So a UK-born retiree with a Cyprus villa may still face UK exposure on worldwide assets. The answer depends on your own history. Read the government's inheritance tax guidance and confirm your position with a UK adviser who knows your timeline. Irish and other nationals face their own rules, because each country sets its own test.

This site's guide to the UK-Cyprus double tax treaty covers income. Do not assume it settles inheritance. Estate treaties are separate, so ask your adviser which one applies.

Which country's succession law governs your will

Guides that focus on paperwork tend to skip a bigger question: which country's law decides who inherits?

Cyprus applies the EU Succession Regulation, which you can read on EUR-Lex. By default, it applies the law of the country where you were habitually resident at death. If you live in Cyprus, that means Cyprus law. The regulation also lets you choose the law of your nationality in your will. A British citizen living in Cyprus can generally choose English law to govern the whole estate, but only if the will says so clearly. The EU e-Justice portal explains how this works.

Why does it matter? Cyprus law protects close family, such as a spouse and children, with a share they cannot be written out of. English law gives far more freedom. A will that quietly assumes that freedom can collide with Cyprus rules if it never states a choice of law.

A decision rule you can use

Ask three questions before you touch a will:

1. Honestly, where will I be habitually resident when I die? 2. Where does each asset sit, and which country's registry controls it? 3. Do I want my nationality's law to apply, and does the will say so in words?

If you cannot answer the first, solve residency first. Tax residency is a separate test from habitual residence, so do not assume the two match.

A worked example: the UK couple with two houses

Take a couple who sell up in England, buy a house in Limassol and keep a small flat in the UK. Each has a UK will written ten years ago, before the move.

That old will may not mention the Cyprus house, may not choose a law, and may name executors who live in England. Before the title moves, Cyprus will want the will translated, certified and processed through a Cyprus court procedure. The UK flat follows its own probate route. The family ends up running two processes in two languages, with no shared plan.

The fix is not exotic. Many people in this position keep one will for each country, drafted so neither cancels the other, with an express choice of law. A licensed Cyprus lawyer should draft the Cyprus will, and a UK solicitor the other.

The part nobody warns you about: the paperwork

Official processes in Cyprus are paper-heavy and done in person. Expect appointments, certified copies and waiting. A grieving family usually needs the death certificate, the will, proof of identity for every heir and documents proving ownership. Foreign documents often need translation and certification.

That is why timing matters more than tax here. A tidy file in a drawer saves your heirs weeks of chasing. It also helps to list everything that will need transferring. Bank accounts, utility contracts and even a vehicle (see buying a car in Cyprus) each follow their own process.

If your heirs plan to stay in Cyprus, they should also understand the running costs of living there. Our cost of living guide is a good place to start.

Your next step

Rules and thresholds change, and much of the guidance online is out of date. Confirm anything material with the Cyprus Tax Department or a licensed Cyprus adviser before you act. This article is general information, not tax or legal advice.

Common questions

Is there inheritance tax in Cyprus?

No. Cyprus does not charge inheritance tax or estate duty on assets passing at death. Heirs can still face transfer charges, later tax on a sale, and tax in another country, so check each one.

Do I still owe UK inheritance tax if I move to Cyprus?

Possibly. The UK moved to a residence-based test from 6 April 2025, so someone who lived in the UK for a long time can stay exposed after leaving. Confirm your own position with a UK adviser.

Which country's law applies to my will if I live in Cyprus?

By default it is the law of the country where you were habitually resident at death. Under the EU Succession Regulation you can choose the law of your nationality in your will. The choice must be stated clearly.

Can I disinherit my children under Cyprus law?

Cyprus law protects close family with a share you cannot simply write away. Choosing your nationality's law in your will can change this. Take advice from a licensed Cyprus lawyer before relying on it.

Do I need a separate will for Cyprus and the UK?

Many people keep one for each country, drafted so they do not conflict and with an express choice of law. A Cyprus lawyer and a UK solicitor should each review the relevant one.
